My tenant is going through a divorce and wants their spouse removed from the lease. What actions should I take? How do I handle this situation? Thats up to you as the landlord. You CAN offer the remaining tenant a new lease IF YOU WANT. Or you can consider one tenant leaving as a termination of the lease. Whatever you choose, do your best to work WITH the tenants. Theres no point in making things difficult for them because it also makes things difficult for you. We had this happen several years ago. A couple moved into one of our houses, and less than six months later filed for divorce. The wife came to us and asked if she could get her own lease, and have her adult son move in with her. We had them fill out an application so we had their updated information, then we released the husband and wife from the existing lease and gave the now-ex-wife and her son a lease instead. Theyve been with us 10 years now.
