Do landlords have to save applications and leases of tenants for any?
Do landlords have to save applications and leases of tenants for any length of time? I had identity theft from 13 years ago, they rented using my identity then got an eviction. Can I get a copy of the lease? You would have to check your specific states laws to see if there is any requirement for them to keep the documents. Here, we have no set time that we have to keep those documents. We keep leases and the application for that specific tenant for no less than 7 years because thats the IRS guidelines for business records. We destroy rejected applications either in the shredder (in spring/summer) or when the boss decides to have a fire in her fireplace, if its winter. We usually destroy old leases 7 years after the tenant leaves. No need to keep them after that point. Of course, our tenants usually stay 712 years, so it could be 20 years before we destroy their original lease.
